Undocumented Immigrants -
Persons who are undocumented
begin acquiring “unlawful presence” on the day they are first in the
United States in an undocumented status (the day they cross the
border or the day they overstay their visa). Persons who are known
to be undocumented more than 180 days will not be allowed to return
to the United States legally for three years, once they leave or are
deported. Persons who are known to be undocumented more than one
year will not be allowed to return to the United States legally for
ten years, once they leave or are deported. There is a waiver of
these bars to admission that a few people are able to get if they
can show that their U.S. citizen or permanent resident spouse or
parent would suffer extreme hardship if they were not granted a
waiver. Persons who have been known to be undocumented more than one
year after April 1, 1997, who then leave the country and then
reenter illegally, can be permanently barred from the United States.
